End User License Agreement

This End User License Agreement (“EULA”) is a legal agreement between you (“User,” “you,” or “your”) and Tarosyn LLC (“Tarosyn,” “we,” “us,” or “our”) governing your use of the Tarosyn mobile application, web application, and any related software, content, or services (collectively, the “Software”). By installing, accessing, or using the Software, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the Software.

1. license grant

Subject to your compliance with this EULA and Tarosyn's Terms of Service, Tarosyn grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of the Software on devices you own or control, solely for your personal, non-commercial purposes.

This license does not constitute a sale of the Software or any copy thereof, and Tarosyn retains all right, title, and interest in and to the Software, including all intellectual property rights therein.

2. usage restrictions

Except as expressly permitted by applicable law or this EULA, you may not:

Copy, reproduce, modify, translate, adapt, or create derivative works of the Software or any part thereof; Distribute, sell, rent, lease, lend, sublicense, transfer, or otherwise make the Software available to any third party; Use the Software for any commercial purpose or for any public display (commercial or non-commercial); Remove, obscure, or alter any copyright, trademark, or other proprietary notices on or within the Software; Use automated tools, bots, scripts, or scrapers to access, collect, or interact with the Software at a rate or in a manner that imposes an unreasonable burden on Tarosyn's infrastructure; Attempt to circumvent, disable, or defeat any technical protection measures, access controls, or usage limitations implemented in the Software; Use the Software to violate any applicable law, regulation, or third-party rights; Use the Software in any way that could damage, disable, overburden, or impair the Software or Tarosyn's servers or networks.

3. reverse engineering prohibition

You may not, and you agree not to or enable others to, reverse engineer, disassemble, decompile, decode, decrypt, or otherwise attempt to derive or gain access to the source code, object code, algorithms, trade secrets, or underlying structure of the Software or any part thereof, except to the extent that such activity is expressly permitted by applicable law notwithstanding this restriction.

You may not use any software, tools, or techniques to analyze, monitor, or intercept the Software's internal logic, network communications, or data flows for purposes other than your personal use of the Software as intended.

Any information obtained in violation of this section is the exclusive confidential property of Tarosyn and must be immediately destroyed.

4. intellectual property ownership

The Software and all copies thereof are proprietary to Tarosyn LLC and title thereto remains in Tarosyn at all times. All applicable rights in patents, copyrights, trademarks, trade secrets, and any other intellectual property rights in or relating to the Software are and will remain the exclusive property of Tarosyn LLC.

This includes, without limitation: all tarot card artwork, deck designs, AI-generated imagery, persona characters, branding, logos, trade dress, user interface designs, reading systems, scoring algorithms, astrological calculation engines, and any content created by Tarosyn or on Tarosyn's behalf.

Nothing in this EULA shall be construed to grant you any right, title, or interest in the Software or in any intellectual property rights therein, except for the limited license rights expressly set forth in Section 1. Your use of any Tarosyn trademark or branding, other than as part of using the Software as intended, is strictly prohibited without our prior written consent.

5. user-generated content

You retain ownership of any original content you create and submit through the Software (“User Content”). By submitting User Content, you grant Tarosyn a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content solely to operate and improve the Software and as described in our Terms of Service.

You represent and warrant that you own or have the necessary rights to any User Content you submit, and that submitting it does not violate any third-party rights or applicable law.

6. updates and changes

Tarosyn may, at its sole discretion, provide updates, upgrades, patches, or new versions of the Software (“Updates”). This EULA governs your use of such Updates unless Tarosyn provides separate terms. Tarosyn reserves the right to modify the Software or discontinue it (or any portion thereof) at any time, with or without notice.

Tarosyn may revise this EULA from time to time. Material changes will be indicated by a new version date. Continued use of the Software after such changes are posted constitutes your acceptance of the revised EULA.

7. disclaimer of warranties

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TAROSYN DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

AI-generated readings, horoscopes, and interpretations provided through the Software are for entertainment and personal reflection purposes only. They do not constitute professional medical, legal, financial, or psychological advice.

8. limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TAROSYN LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF TAROSYN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TAROSYN'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THIS EULA OR THE SOFTWARE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TAROSYN IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

9. termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically, without notice, if you fail to comply with any of its terms. Upon termination, you must cease all use of the Software and delete all copies thereof. Sections 3 (Reverse Engineering Prohibition), 4 (Intellectual Property Ownership), 7 (Disclaimer of Warranties), 8 (Limitation of Liability), and 10 (Governing Law) shall survive any termination.

You may terminate this EULA at any time by deleting your account and uninstalling the Software. Account deletion is available in Settings → Account or by emailing [email protected].

10. governing law

This EULA shall be governed by and construed in accordance with the laws of the United States and the state in which Tarosyn LLC is organized, without regard to conflict-of-laws principles. Any dispute arising under this EULA shall be subject to the exclusive jurisdiction of the state or federal courts of that state, and you hereby consent to personal jurisdiction therein.

If any provision of this EULA is held to be unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

11. entire agreement

This EULA, together with Tarosyn's Terms of Service and Privacy Policy, constitutes the entire agreement between you and Tarosyn with respect to the Software and supersedes all prior or contemporaneous understandings, communications, or agreements, written or oral, regarding such subject matter.
